What Are You Entitled to as Unearned Wages?
Under general maritime law, seamen are entitled to unearned wages. Unearned wages are the wages the seaman would have earned to the end of the contemplated period of employment, usually to the end of the voyage or fishing trip. In some cases it may be possible to get unearned wages for a period longer than set forth in the contract of employment.
Unearned wages include all compensation you would have received for the duration of the contemplated period of employment had you not been injured. This includes performance bonuses, contract completion bonuses, overtime, tips and other forms of earnings you would have normally received before injury.
